Adventure Tour Terms of Service

By submitting your booking, you acknowledge and agree to the Terms of Service outlined in this Participation Agreement.

INVOICES

You will receive two invoices.

AdvAnywhere company is not a travel agency. From AdvAnywhere you will get the invoice for photography services and products included in your trip offer.

You will receive a second invoice from our Guide in the Pokhara office, where the final payment balance is made.

PAYMENT AND TRIP PRICING

  1. Booking and guide payments must be made 90 days prior to your trip departure but can be made anytime prior for your convenience. Payments made after the 90-day deadline will be assessed a $150 fee.
  2. All pricing is listed in US dollars.
  3. Failure to submit a $1000 deposit 90 days from the trip date may result in automatic cancellation and forfeiture of any funds paid.
  4. Final price: the remaining amount should be paid in cash or by card on arrival at our guide office in Pokhara.

AIR TICKET PURCHASING

Airline tickets to and from Nepal are not included and the participant must purchase them independently. Please wait to purchase airfare until the trip minimum is met and confirmed by our office OR purchase airfare at the time of booking if the airline offers free cancellation and full refunds.

REFUNDS

  1. Cancelation 90 days or more before trip departure: only the $500 booking reservation fee will be refunded.
  2. Cancelation 90 days or less before trip departure: no refund applies.

FORCED MAJEURE CANCELLATIONS & RESCHEDULED DATES

  1. Forced Majeure Cancellations: In circumstances where a cancellation is necessary due to any conditions or events beyond our control, including but not limited to natural events, pandemics, border restrictions, terrorism, or political instability, we will endeavor to transfer your booking to an alternative departure or trip, or we will offer a trip credit to use towards the balance of any new booking.
  2. Non-Refundable Expenses: Any credits or refunds resulting from cancellation for any reason will be less than any non-refundable expenses incurred by us. We are not responsible for any additional expenses you may incur as a result of your booking being canceled or changed, including but not limited to visas, vaccinations, medical expenses, clothing, equipment, testing, quarantine, travel insurance excess, or flights.
  3. Termination and Refunds: In the event of forced cancellation or rescheduling due to unforeseen circumstances, the company will handle terminations and refunds in accordance with its policies.
  4. Event Beyond Control: Neither party shall be liable for any failure to perform obligations due to events beyond their control, including but not limited to natural disasters, pandemics, political unrest, terrorism, or airline disruptions. Both parties shall inform each other promptly of any such events. In the event that a client has to cancel participation in an expedition due to an event beyond control, booking and guide fees are refunded, less $200.

DOCUMENTATION FOR ENTRY TO NEPAL

  1. Visa Requirements: You can acquire your tourist visas on arrival. We require two additional passport photos to be emailed to our office 90 days prior to departure, as well as proof of travel insurance to secure permits necessary to enter national parks in Nepal.
  2. Passport Validity: All travelers must have a valid passport with 6 months of validity beyond the departure date from Nepal. Your passport must also include one free page for the entry visa stamp.

VISAS AND ENTRY REQUIREMENTS

  1. Individual Responsibility: It is each guest’s own responsibility to know and meet the requirements for entry to Nepal. The company is not liable for any disruption to trips or any associated costs incurred as a result of failure to meet these requirements.
  2. Travel Insurance: Travel insurance is required to obtain permits for restricted areas in Nepal.

HEALTH, SAFETY, AND DISCLOSED ABILITIES

  1. Medical Precautions: We advise all guests to consult their doctor or travel clinic regarding medical precautions and any specific health concerns relating to the destinations visited. Please ensure that you have all necessary vaccinations for the countries visited.
  2. Disclosed Health Conditions: Guests must inform us in writing at the time of booking of any existing physical or mental illness, disability, or any other condition that may affect their ability to participate in the trip. We reserve the right to request further information or professional medical opinions. Failure to disclose any relevant information may result in the cancelation of your trip and forfeiture of funds paid.

DISCLAIMER: ACCEPTANCE OF TRAVEL RISKS

On our motorcycle adventure trips, we take you to remote, undeveloped, and occasionally unpredictable regions of the world. It is important to acknowledge that we cannot guarantee protection against all risks associated with food, health, disease, or injuries during your travels. Traveling inherently carries certain dangers, and accidents can and do occur. As per the applicable laws of Poland, we hereby state that we are not held liable for any mishaps or accidents that may transpire.

By submitting your deposit and confirming your participation, you expressly agree to the following statement and fully comprehend the risks involved in travel:

“I understand and accept that travel to remote destinations involves inherent risks and uncertainties. These risks may include but are not limited to food-related health issues, diseases, and injuries. I acknowledge that accidents can happen and that the company cannot be held responsible for such incidents to the extent permitted by the applicable laws of Poland. I willingly assume all risks associated with this travel and absolve the company of any liability arising from unforeseen circumstances.”

Your safety and well-being are of utmost importance to us, and we strive to ensure a safe and enjoyable experience. However, it is essential that you recognize and acknowledge the inherent risks and uncertainties associated with travel to remote areas. By consenting to this disclaimer, you join us on this adventure with a clear understanding of the potential risks involved.

MOTORCYCLE RIDER REQUIREMENTS

Rider Eligibility: Riders must hold a valid motorcycle license with at least one year of road-riding experience. All riders must meet the age requirements and licensing regulations of Nepal.

DAMAGE TO MOTORCYCLES

Damage Responsibility: Riders are responsible for any damage caused to motorcycles or third-party property as a result of accidents. Minor damages up to $200 are waived. Damages exceeding $200 must be paid by the rider within 60 days.

TERMINATION, SAFETY, AND CONSENT

  1. Termination and Removal: The Company reserves the right to terminate the agreement and remove a participant from the trip if their behavior, health, or conduct is deemed detrimental to the safety, enjoyment, or well-being of themselves or others.
  2. First Aid Administration: Participants consent to first aid administration as deemed necessary by our staff or medical professionals if required during the trip.
  3. Release of Liability: Participants release the company from any liability for actions taken under the circumstances described in point 2 above.

ALCOHOL CONSUMPTION

  1. Alcohol Consumption Prohibited: Riders are prohibited from consuming alcohol while in possession of motorcycle keys. Once the keys are turned in for the day, participants may enjoy alcohol in moderation.
  2. Altitude Alcohol Consumption: Alcohol consumption is advised against above 3000m attitude due to the increased risk of altitude sickness.

PHOTOGRAPHS AND FILMING

Media Capture: The company may take photographs and videos during the trip for promotional and marketing purposes without any payment or consideration to participants. Thus, the participant agrees that the company is allowed to publish his or her image.

ITINERARY CHANGES

Flexibility: The planned itinerary is subject to change due to unforeseen circumstances or events beyond our control. Flexibility is required for traveling to remote destinations.

ASSUMPTION OF RISK

Inherent Risks: Travel to remote areas carries inherent risks, including but not limited to physical exertion, remoteness, weather conditions, political instability, and limited medical facilities. By participating in the trip, guests assume responsibility for their own safety and release the company from liability to the extent permitted by law.

MERCHANDISE

  1. A shirt and balaclava listed in the offer will be provided on the 1st day of the tour, or earlier if possible.
  2. A photo book, digital photocopies, and videos listed in the offer will be delivered as soon as they are ready but not longer than 6 months after finishing the tour.
  3. All wear is made on demand which means no return is possible. Please check out the size charts before ordering. Please keep in mind that thermoactive wear should be a little smaller than you normally would choose.

TRANSFER OF PERSONAL DATA

To make a hotel reservation, domestic flights, and obtaining restricted area permits your data from the booking form will be sent to our Guide in Pokhara, Nepal.

GENERAL

  1. In matters not covered by these Regulations, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the 18th of July 2002 Act on Rendering of Electronic Services (Journal of Laws of 2002 no. 144, pos. 1204 further amended); the Consumer Rights Act; as well as other relevant provisions of generally applicable law.
  2. Any disputes arising from these terms and conditions shall be resolved through arbitration.
  3. The company reserves the right to change these terms and conditions as needed, with notification of changes provided.

NOTIFICATION OF CHANGES

It is the traveler’s responsibility to stay updated on any changes to the terms and conditions. The company will provide notification of changes via email or through its website.
